Terms & Conditions
1. PREAMBLE & THE “KARLITO’S WAY” EXPERIENCE
1.1. The Contract: This agreement is between Karl Mallia (trading as Karlito’s Way Travel Operation, MTA Licence: TRA/K/16, “the Organizer”) and the Client.
1.2. Bespoke Design: All tours and experiences are exclusively designed and led by the Organizer. While we may subcontract specific elements, the creative direction, and onsite leadership remain the sole responsibility of Karlito’s Way.
1.3. Acceptance: By paying the deposit, the Client confirms they have read, understood, and accepted these Terms & Conditions.
2. PRICING & PAYMENT
2.1. VAT: All rates are exclusive of 18% VAT unless explicitly stated otherwise.
2.2. Payment Schedule: Engagement is confirmed only upon receipt of the deposit.
- Deposit: 30% due on confirmation (Non-refundable).
- Interim/Balance: Paid according to the specific schedule provided in your quotation.
2.3. Bank Transfers: We accept direct bank transfers. All bank charges are to be borne by the Client. Bookings are only finalized once funds have cleared in our account.
3. CANCELLATION & REFUNDS
Amounts forfeited reflect reserved capacity, pre-paid subcontractor costs, and loss of opportunity.
- Cancellation before the agreed “Cut-off Date”: Loss of 30% of total fees.
- Cancellation after Cut-off but > 7 days before event: Loss of 75% of total fees.
- Cancellation within 7 days of the event: 100% of total fees.
4. CULINARY & HEALTH SAFETY
4.1. Food Safety: All food is prepared in compliance with Maltese food safety law.
4.2. Allergy Responsibility: The Client is responsible for communicating all guest allergy and dietary information by the agreed cut-off date. We accept no liability for adverse reactions arising from incomplete or late information.
4.3. Venue/Vessel Safety: Guests must follow all safety protocols provided by the Organizer or the subcontractor.
5. TRAVEL DOCUMENTATION & INSURANCE
5.1. EU Travel: For EU citizens traveling within the Schengen area, a valid National ID card is typically sufficient. It is the Client’s responsibility to verify if their specific carrier requires a passport.
5.2. International Travel: Non-EU citizens or those traveling outside the EU must ensure a valid passport (6 months validity) and necessary visas are held.
5.3. Insurance: We strongly recommend that all Clients hold comprehensive travel insurance. Karlito’s Way is not liable for costs incurred due to a lack of personal travel or medical insurance.
6. DATA PROTECTION & PRIVACY
6.1. Processing: We collect and process your personal data (including identity and travel documents) solely to fulfill your travel arrangements and comply with Malta Tourism Authority regulations.

7. LIMITATION OF LIABILITY & PROTECTION
7.1. Liability: Our liability is limited to direct losses only and shall not exceed the fees paid for the relevant experience.
7.2. Insolvency: As a licensed MTA operator, your payments are protected by the Insolvency Fund for Travel Agents in Malta.
8. GOVERNING LAW
This agreement is governed by the Laws of Malta. The Courts of Malta have exclusive jurisdiction.
